In some cases, a child suffers an injury while trespassing on someone else’s property. If this happened to your child, do you still have the grounds to file an injury claim? It depends on the circumstances of the accident, so don’t assume you can’t file a claim or lawsuit.
Illinois has an attractive nuisance law that allows property owners to be held responsible when a child is injured after trespassing on their property to get closer to or play with something that “looks fun” on their property if that property owner did not take reasonable steps to prevent the trespass. In other words, property owners, including homeowners, need to make a reasonable attempt to stop children from entering their property unattended if there is something on their property that could be dangerous to them.
For example, if a homeowner has a swimming pool that can be seen easily by a child walking by the property, then the homeowner should do something to stop children from entering the pool unattended. Installing a secure fence around the property or a locking fence-gate system around the fence would be appropriate solutions. If the homeowner takes no such precautions and a child falls is injured or passes away after falling into the pool, the attractive nuisance law could allow that child’s parent to file an injury claim against the homeowner.
