CPAP Recall
In June 2021, Philips Respironics issued a recall of its CPAP and BiPap devices due to complaints that the foam used to insulate its products degraded, leading to potential injuries from inhalation and toxic fumes.
CPAP Therapy
CPAP therapy is the standard form of treatment for sleep apnea. Users wear a mask over the nose and mouth where positive airflow is delivered to create inward pressure to prevent the user’s airway from collapsing during breathing at night. Essentially, CPAP machines and other mechanical ventilators force air into the airway where there is an obstruction and prevents respiratory depression.
What Is A CPAP Lawsuit?
Following the FDA’s warning that Philips’ CPAP devices have been associated with potentially life-threatening health risks, thousands of victims have filed lawsuits. In Philips’ CPAP filings, victims stated that the recalled devices used a sound reduction foam that disintegrates and releases dangerous chemicals and tiny particles into the lungs.
If you have been harmed due to a recalled Philips CPAP device, you may be eligible to pursue legal action. A CPAP litigation lawyer can help you identify the damages you have suffered and build a solid case to obtain the justice you deserve.
The following are devices recalled for potential health risks and cancer:

With the help of an experienced CPAP litigation attorney at Hilliard Law, we can evaluate your claim and assess your best legal options to obtain the justice you deserve.
Texas Product Liability Litigation
Plaintiffs have asserted that Philips failed to warn consumers of the potential dangers of using their CPAP devices. By filing a product liability case, consumers can hold manufacturers and entities accountable for creating an unsafe product. Because of the CPAP foam breaking down within CPAP and ventilator machines, and the potential for adverse health conditions and illnesses to those who ingested the gas and particles, Philips may be held liable for damages
In a product liability lawsuit, your experienced CPAP litigation attorney at Hilliard Law must demonstrate that the injury or illness incurred was directly caused by Philips. Product liability cases may involve the defective design of products and defective manufacturing of products.
In a “failure to warn” product liability lawsuit, injured parties demonstrate that they suffered harm as a result of manufacturers not communicating known issues or dangers with their products. A manufacturer has a responsibility to warn users of known risks associated with their product.
Potential Health Risks and Injuries from Recalled Philips Devices
Numerous health risks have been attributed to the foam degradation process, both from inhaling the particles and from exposure to the particulates and gases.
Risks include:
When there is the presence of black debris/particles within device’s airways
- Headache
- Upper airway irritation
- Cough
- Chest pressure
- Sinus Infection
Where users are exposed to particulates
- Irritation to skin, eyes, and respiratory tract
- Inflammatory response
- Headache
- Asthma
- Cancer, especially lung, kidney, and liver
When chemicals are released into the device’s air pathways from the PE-PUR foam
- Headache
- Dizziness
- Irritation in the eyes, nose, respiratory tract, skin (or hypersensitivity)
- Nausea/Vomiting
- Toxic and carcinogenic effects
