Nationwide Above-Ground Pool Recall Lawyers

In July 2025, a massive recall was announced by the U.S. Consumer Product Safety Commission (CPSC) for more than 5 million above-ground pools manufactured by Bestway Inc., Intex, Recreation Corp., and Polygroup North America Inc. The above-ground pools, sold at major retailers for more than two decades, contain a dangerous design flaw that has already led to the deaths of at least nine children: a compression strap can be used by a small child as a foothold to climb into the pool.

At Hilliard Law, we’re taking a stand for families who have been devastated by this design defect. If your child was injured by a recalled pool, our product liability attorneys want to hear from you to see if you have a case and how we can help. We’re currently accepting cases nationwide, meaning you can reach out to us, no matter where you live. Our team is highly experienced and trauma-informed, so you can trust us to handle your case with respect, sensitivity, and confidentiality.

Compression Strap Design Defect Puts Children in Danger

The CPSC announced the recall of a selection of 48-inch and taller above-ground pools from Bestway, Intex, and Polygroup. It was determined that a compression strap used in the pool’s design can act as a foothold, allowing young children to climb into the pool unsupervised, even without a ladder present. Currently, the CPSC is aware of at least 9 deaths related to the compression strap design defect, as well as multiple other nonfatal incidents, dating back to 2007.

How to Check If Your Pool Has Been Recalled

Worried your backyard pool may be one of the dangerous models?

  • Check the model name and serial number printed on your pool’s manual or frame.
  • Visit the official CPSC recall notice by clicking here.
  • Consider getting a manufacturer-provided repair kit to address the compression strap hazard.

If your pool is listed, do not allow children to have unsupervised access, and remove ladders until it has been properly fixed. You can also completely drain the pool in the meantime. We’ve also published a detailed blog post on what to do if your pool is part of the recall and how to protect your child in the meantime, which you can read by clicking here.

Legal Options for Families Harmed by a Recalled Pool

When a company releases a defective product that harms children, it must be held accountable through legal action. At Hilliard Law, we have decades of experience handling complex product liability cases against major manufacturers. We know how to uncover negligence, secure important evidence, prepare strong claims, and fight for the full compensation families deserve, including going in front of the court for litigation.

You may have a case against an above-ground pool manufacturer if:

  • Your child was injured or drowned after gaining unsupervised access to a recalled above-ground pool;
  • The pool involved was one of the recalled pool models from Bestway, Intex, or Polygroup; and,
  • You have proof of ownership of a recalled pool (such as a photograph of it on your property or a purchase receipt).

Keep in mind that the recall doesn’t protect the pool manufacturers from liability for any harm caused to children. If your child was hurt by a defectively designed above-ground pool, even after the recall was announced, you could still have the grounds to file an injury claim or wrongful death lawsuit.

Pool Recall Lawsuit FAQs

Is my pool model included in the recall?
Check your pool’s model number against the CPSC’s list (found here). Pools included have compression straps around the exterior frame and are generally 48 inches tall or taller.

What if my pool is older or I bought it secondhand?
Even older or resold pools can be included in the recall. If the design defect exists and caused harm to your child, you may still have a valid legal claim.

What if the injury happened before the recall was announced?
You may still be eligible to file a lawsuit. Recalls often come after years of injury reports are collected, and companies can be held liable for failing to act sooner.

Can I demand compensation?
Yes. Compensation to pursue may include medical bills, funeral costs, pain and suffering, emotional distress, and punitive damages, depending on your case.

What does a swimming pool injury attorney do?
We can investigate how the injury occurred, prove the product was defective by design, and prepare a compelling claim for full compensation. At Hilliard Law, we also handle all communications and negotiations with the pool manufacturer and their insurance team on your behalf.
